Permission to perform regular international transport outside the EU

 If you want to carry out regular international transport of passengers by buses outside the territory of the European Union, Norway, Iceland, Liechtenstein or Switzerland, you should  obtain a special permit. Regular transport is the public transport of passengers at specified intervals and along specified routes. The place of departure should be in an EU member state, Norway, Iceland, Liechtenstein or Switzerland, and the place of arrival in a third country. Buses should be registered in the EU member state where the entrepreneur is based. If you want to obtain a permit from the Polish Chief Inspectorate of Road Transport, they should be registered in Poland.

 To obtain this permit, you must have an EU license for international commercial passenger transport by bus and coach. You can read about how to obtain an EU license in our previous article: https://business-in-poland.eu/ru/articles/view/eu-license-for-international-commercial-passenger-transport-by-bus-and-coach/

An application for a permit to provide regular services outside the European Union should be submitted to the General Inspectorate of Road Transport in Warsaw. All vehicles indicated in the application must have previously been registered for the EU license. You will receive as many extracts of the permit as the number of vehicles you have registered for the license. The following documents must be attached to the application:

  1. The timetable (signed and stamped by the Polish entrepreneur and foreign partner) - agreed with the foreign road carrier intended for regular transport on a given regular line, containing the names of the stops (along with addresses), the time of departures and arrivals from the stops, names of border crossings (two-sided), length of a regular line in kilometers, distance between stops;
  2. Agreement with a foreign road carrier on joint operation of a regular line;
  3. The driver's working and rest time schedule (both sides of the route) - developed in accordance with the European agreement concerning the work of crews of vehicles engaged in international road transport (AETR);
  4. A map with a marked route of transport along with a confirmation of posting it to the Marshal's Office (competent for the entrepreneur's seat);
  5. Tariff of charges for international regular transports (in PLN and the currency of the country to which the line is planned) - signed and stamped by the Polish entrepreneur and foreign partner;
  6. Copy of the EU license for international commercial passenger transport by bus and coach;
  7. Copy of the EU license of the foreign road carrier (partner) intended to provide scheduled services on a given regular line;
  8. Confirmation of agreeing the rules of using the railway station facilities and stops with their owners or managers (eg copies of contracts, declarations);
  9. Original or a copy of the power of attorney certified by a notary public from a foreign partner to conduct matters on its behalf, related to the granting of the authorization, together with stamp duty.

The amount of fees for the permit depends on the period of validity of the permit, as well as the number of initial stops on the territory of Poland. The fees for the permit for regular transport, performed by bus in accordance with the timetable containing one starting stop on the territory of Poland, are as follows:

  • 400 PLN for a permit valid up to 6 months + 4 PLN for each extract from the permit
  • 800 PLN for a permit valid up to one year + 8 PLN for each extract from the permit
  • 1500 PLN for a permit valid up to 2 years + 15 PLN for each extract from the permit
  • 2200 PLN for a permit valid up to 3 years + 22 PLN for each excerpt from the permit
  • 3000 PLN for a permit valid up to 4 years + 30 PLN for each extract from the permit
  • 3700 PLN for a permit valid up to 5 years + 37 PLN for each extract from the permit

The fee is paid to the bank account of the General Road Transport Inspectorate. The fee applies to each partner reported in the application. The title of the transfer should include the tax identification number of the Polish entrepreneur, as well as the full name of the foreign carrier and the title of the transfer "linia poza UE trasa" (line outside the EU). In the case of acting through a proxy, an additional stamp duty for the power of attorney must be paid in the amount of 17 PLN. If you submit a complete set of documents and issue a positive decision, you will receive a permit and excerpts for the Polish company and the foreign partner (carrier).
