Entry of invitations for a foreigner to the Polish register of invitations

 The invitation is a document that allows a foreigner to obtain a visa. On this basis, foreigner can apply for a visa, the purpose of which is marked with the number "02", which is the purpose of visiting family or friends.

 The invitation doesn’t entitle foreigner to work in Poland. However, if the foreigner is in Poland on a visa on this basis, foreigner may work on the condition of obtaining a work permit or registering a declaration of entrusting work. A major limitation for a foreigner who entered Poland on the basis of a visa issued on the basis of an invitation is that it isn’t possible to submit an application for a uniform temporary residence and work permit. Polish law stipulates that foreigners who stay in Poland on the basis of a tourist visa or to visit family or friends can’t apply for a uniform permit.

The invitation is entered into the register of invitations at the request of the inviting person. The authority competent to enter the invitation to the register is the voivode competent for the place of residence or seat of the inviting person. The invitation is valid for the period indicated by the inviting person, but it can’t be longer than 1 year. The inviting person may be:

  • a Polish citizen residing on the territory of the Republic of Poland, a citizen of another European Union Member State, a member state of the European Free Trade Association (EFTA) - parties to the agreement on the European Economic Area or the Swiss Confederation, a citizen of the United Kingdom of Great Britain and Northern Ireland, or a family member, residing in the territory of the Republic of Poland and having the right of residence or the right of permanent residence in this territory,
  • a foreigner residing legally and continuously for at least 5 years on the territory of the Republic of Poland before issuing the invitation or holding a permanent residence permit or a long-term resident's EU residence permit,
  • a legal person or an organizational unit without legal personality, established in the territory of the Republic of Poland.

The inviting party, when applying for an invitation to be entered into the register of invitations, fills in a form that contains, inter alia, information on the number of foreigners invited during the year preceding the submission of the application for entering the invitation into the register of invitations, the inviting person's financial and economic possibilities, as well as the conditions of accommodation of the invited foreigner. The inviting party undertakes to cover the costs related to the foreigner's stay, including the costs of accommodation, meals and possible treatment, costs of return travel to the country of origin or residence, or the costs of transit to a third country which will grant the entry permit, and the costs of issuing and implementing the decision on obliging the foreigner to return. Along with the application, the inviting person should present an ID card or passport, documents confirming the possibility of covering the costs related to the foreigner's stay (e.g. bank account statement), a document confirming the legal title to the apartment in which the foreigner will be accommodated (e.g. notarial deed) and confirmation of payment of the stamp duty for the invitation (27 PLN).
